1. Agreement to Terms

By accessing or using Nailart ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Nailart is an AI-powered platform that generates nail art thumbnail images based on user-provided text prompts and reference images. Our service utilizes artificial intelligence technology to create unique visual content for personal and commercial use within the bounds of these Terms.

3. User Accounts

When you create an account with us, you must:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Credits and Payments

4.1 Credit System

Our service operates on a credit-based system. Each image generation consumes credits from your account. Credits are non-refundable and non-transferable unless otherwise stated.

4.2 Subscription Plans

  • Pro Plan ($20): 100 credits
  • Ultra Plan ($45): 300 credits

4.3 Payment Terms

All payments are processed securely through Polar. By purchasing credits, you agree to pay all applicable fees and authorize us to charge your payment method. Prices are subject to change with notice.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, or harassing
  • Create content that infringes on intellectual property rights
  • Generate explicit, pornographic, or sexually suggestive content
  • Create content depicting violence, gore, or harm to individuals
  • Produce content that promotes discrimination or hate speech
  • Generate deepfakes or misleading content of real individuals
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Use automated systems to access the Service without permission
  • Resell or redistribute generated content without proper rights

We reserve the right to terminate accounts that violate these policies without refund.

6. Intellectual Property Rights

6.1 Your Content

You retain ownership of any images you upload as reference materials. By uploading content, you grant us a limited license to process and use that content solely for providing the Service.

6.2 Generated Content

Subject to compliance with these Terms, you are granted a license to use images generated through our Service for personal and commercial purposes. You may not claim that AI-generated images are human-created when disclosure is legally required.

6.3 Our Property

The Service, including its original content, features, and functionality, is owned by Nailart and is protected by international copyright, trademark, and other intellectual property laws.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results from the Service will be accurate or reliable
  • The quality of any products or services will meet your expectations
  • Any errors in the Service will be corrected

8. Limitation of Liability

IN NO EVENT SHALL NAILART, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless Nailart and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nailart operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
